END-USER AGREEMENT FOR THE "MyMetar" TWITTER SERVICE AND "METARS" Twitter application. PLEASE READ THE TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT CAREFULLY BEFORE CONTINUING WITH USING THIS SERVICE. The term "us" and "we" referes to iChoice Pty Limited, MyMetar, flight.org or any other organisation connected with our extensive media network. The iChoice Pty Limited End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and us. By installing, copying, or using MyMetar (weatheraviation.net or Twytter.net), you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not use this or any other of our products. We grant you the right to use our free service on a Twitter account registered to you for legitimate purposes only. Using our service on an account that is deemed to be 'spam' will result in termination of your service. We will auto-follow two accounts on your behalf for each account we're connected with: @MyMetar and @FlightPodcast. The former is an account that will broadcast important news relating to the use of our service. The latter is a 'sponsored' follow as 'payment' for the continued free service. Unfollowing either account is deemed to be in breach of our agreement and will result in automated account termination. Each tweet is sent via the 'METARS' application registered with Twitter. We reserve the right to change the name of the application and web link at any time. We reserve to right to terminate your service for any reason. Such reasons may include: suitability of the service, excessive duplication of the same information on multiple accounts, inappropriate usage, abuse or multiple registrations. We reserve the right to suspend a 'free' service without providing reasons for doing so. Premium account holders will be contacted before we take such action. The service is provided 'As Is' without any express or implied warranty, longevity, or any promise of continued service. We do not warrant or assume responsibility for the accuracy or completeness of any information, links or other items contained within the information we provide. In the case of MyMetar (Metar to Twitter), the information should never ever be used as a substitute for valid operational resources. For all intensive purposes, the information should be considered out of date and invalid. We provide information at regular intervals determined by us - not the release of what is likely more accurate information. In no event shall we be liable for any damages (including, without limitation, lost profits, business interruption, or lost information) rising out of use of or inability to use the service, even if we have been advised of the possibility of such damages. In no event will we be liable for indirect, special, incidental, consequential (including lost profit), or other damages. We shall have no liability with respect to the content of any information we provide. You may terminate your service with MyMetar at any time by selecting "Deauthorise" in your account's "application" settings. When sending a failed tweet, we repond by immediately deleting any data we maintain on our servers. If we recieve a response from Twitter indicating that we are not authorised to post to your account, or your account no longer exists, we will immediately delete any record of your service in our database. If this is done in error, you may re-authorise us to continue service. PRIVACY We respect your privacy and will never abuse our relationship with you that is established via the oAuth connection. OAuth is an authentication protocol that allows users to approve application to act on their behalf without sharing their password. You can at any time revoke permission for us to access your Twitter account from the Twitter.com website. If you do so, you will not be able to use any of our multiple applications. On our website, We use the IP address of all visitors, URI’s of requested resources, timestamps and HTTP user-agents to analyse trends, administer the system and gather broad demographic information for aggregate use. In addition to this we use Google Analytics, a web analytics service provided by Google, Inc (“Google”). You should be aware that Google has its own privacy policy that dictates how their records of your online behaviour is used. If you register to our mailing list, we assure you that it will not be used for any purpose other than contact you with important news relating to the use of MyMetar and other services we offer. Our load of email is very light. You will have the option to immediately unsubscribe at any time. This agreement may change at any time. |
